It remains unclear why the charge for the attack was only second degree assault when the attack clearly could have killed the girl or left her with permanent brain damage.

This sort of reasoning is a thing that happens with prosecutions. Anarcho-tyranny is absolutely on the table as a possible explanation but it isn't the only explanation.

It could be as simple as "we want a conviction and it's easier to make assault charges stick than to get attempted murder."
Or more likely, it's anarcho-tyranny, where the rules apply to you and me, but not to the good little foot soldiers for the establishment.
