No, you codify rules that allow for exceptions. There has never been a rule of law or societal norm that carved out exceptions after the fact without some form of coercion or violence.

Yes, the average somalian is retarded. If we eliminate the benefits for taking them in regardless and return everything to a "sink or swim" meritocracy, they'll either fuck off back to their mudhuts, starve in the streets, or die when cops or private citizens make good shoots of they try comitting crimes.
However, it's possible for there to be a statistical outlier born amongst them who isn't retarded, or is even intelligent. We don't need a system that throws them away for the crime of association with a poor performing group. If they have a brain and can learn to act like a human, they should be able to join human society. What you're proposing codifies the opposite, and you're pretending people who grow up under such a system would be willing and able to consider after the fact exceptions.

Intelligence is pretty heritable so if they're exceptionally intelligent their first generation children are likely to be remain above average for a Somalian.
But intelligence heritability is also genetically very complex so their children are very likely to regress towards the mean from random variation, and when the mean is 60 IQ retards it really doesn't take much regression to make that a shit deal for the country.
That's where eugenic practices come in. Not that Somalians would be likely to practice them
