Not sure he tried to draw his gun ( we will only get bodycam footage if it helps the officers on this one ), but from one angle we can clearly see one officer getting the suspect's gun away, and within 1 or 2 seconds the guy gets shot a couple times.
So either there is info missing ( another weapon ), more likely a misunderstanding ( ICE shooter though the suspect pulled his gun, unfortunate but not murder ), or the ICE shooter just decided to shoot anyway after understanding the threat was removed ( murder ).
That one could go to trial, but unlesss there is incriminating evidence against the officer, he could ( honestly or not ) claim he understood the suspect had pulled his gun, and walk free.
It's also possible the feds make it so there is no trial. The ICE director already ran his mouth claiming the dead guy had a gun with two magasines ( he had a gun at least that's sure ) so he planned to massacre officers ( such claim requires more evidence than a legal-carry in its holster ).
The dead guy put himself where he should not have been. He got right to the face of the ICE officer who had just shoved another pest / protestor out of the road. He deserved to get his ass kicked off the road and an arrest, not to get shot. Play stupid games, win stupid prizes. Unfortunately for him, he hit an unlikely Darwin jackpot there.
This isn't like the Good shooting. Renée Good was an active danger to the officer and others when the officer shot, and all the shots were within less than 1 second. ( Suspects slamming the gas pedal to escape arrest can and do main and kill innocent people down the road too. The driver brought this all on herself. )

Best explanation I heard: he was a victim of a random fire from his Sig (that model is NOTORIOUS for that) as the agents were removing the weapon
