The judge is going to rule on the charges, not on returning someone to power. And yeah, if he isn't an activist, he's going to laugh these charges out of court.
If the judge rules that his arrest was "illegal" then what do you think that's going to mean? Sure, the Trump admin could just ignore the ruling but so far he hasn't ignored jack shit from these activist judges. If the court rules that his arrest was "illegal" then BY LAW he has to be released.

I agree. He's probably an activist who's going to follow the US security state's dictates.
Not even activist judges have the ability to return him to power. You just keep the charges and trials (with different judges) coming until your new regime is in solidified. They already got him to waive his right to a "speed trial."
Even if somehow he walks on all of them, none of the Venezuelans in power by that point will want to step aside to let him back in.
