I happened to see coverage on Sportnet tonight after the verdict came in.
"Trust the experts..." this isn't even legal lol.

Know that I think about it, there was also some comment on SN (maybe from the Crown Attorneys?) about trying to set precedent about the responsibilities of bystanders.
After reading your hearsay synopsis, it seems that they are also trying to establish case law that simply being present for an alleged crime essentially makes you guilty of the offense by association, similar to the crowd control cop in the Derek Chauvin case.
They seem to be implying that the bystanders had a duty to act and intervene. Which would make sense why they are trying all 5 as a group if by your contact's account only 3 had any sexual congress.

"Duty to intervene" just makes everyone guilty all the time. Because "Duty to intervene" is synonymous with "Vigilantism", which is ALSO illegal, generally speaking.
Yes but what really fucks the prosecution up in this is she was gleefully masturbating for everyone when pizza guys were there and willingly walking up to one of them to suck his dick, then fuck another in the bathroom. None of these guys had any idea that Michael might not have necessarily asked her if she wanted a threesome. The defendants lawyer pointed this out and said how absurd it was that they could get in trouble because they had no reason to suspect there wasn't consent.
There's still the separate issue of why they would choose to try the two pizza guys who had no physical contact whatsoever in the same clusterfuck activist trial of the 3 other guys with the He Said, She Said likely consensual contact.
At most, they should've been called as witnesses.
