I am not a lawyer, but I understand constitutional rights apply to any person present in the USA LEGALLY, as long as the non-citizen doesn't extend the stay illegally.
Of course, I cannot buy a gun or anything in that regard, but as a non US citizen just visiting I am still can use the 1st, the 4th and the ones you don't have to be a citizen, like voting.
I would say a good percentage of the protestors are not legally in US

You cannot be prosecuted for exercising your God given rights. You can still be deported.
Of course, you (in case me) not a citizen cannot think of any protections of extra rights I might have, this on every country I am not citizen of
