Not sure what the initial conflict was about, but the dude all up in the employee's face was being a pussy. Employee struck first, but there does come a point where that's acceptable. Whether that reached it is up to interpretation...I'm not sure. Also, employee was escalating too. Followed the guy, was getting up in his face too. He wanted to the fight. Other guy wanted to do everything but fight, which is ultra-pussy behavior.
Then he takes off his hat and jacket, and looks like he actually wants to fight...then just spits on the guy repeatedly. Here's where he definitely deserves a beating. Fuck that shit. Fight or don't. Again, he wanted to do everything but fight, including spitting blood on the employee. Fuck that. Let him have it, at that point.
Fight or walk away. Don't do the pussy middle ground of refusing to throw a punch but spitting on the guy. Basically, his behavior was so bad and dishonorable that I find myself more siding with the employee...whether or not the first punch was justified. But they were both punk bitches.

Personally the limit got reached when glasses did the hand wave around the employee's head and taunt squaring up.
