This is why it's so important to have a Constitution that is an original source of our clearly delineated rights.

When we get too far away from it somebody looks back and says, hey wait a minute, it doesn't actually say anything about "hate speech".

This is where Canada screwed up. Not only is their Charter of so-called Rights and Freedoms recent, so it's not venerated by time, but it allows for any infringement of any right that is "justified", which is so vague and ill-defined that it provides no protection at all from this "copy of the copy" aka fad-chasing moral decay; it's justified to imprison you for not using the right pronouns because the current fad says that's justified.
