An identity attack doesn't apply unless it's actually an attack on an identity group. Attacking an individual would never fall under Rule 16 so long as you didn't generalize the personal attack as an extension of their immutable group.

No, because for the most part it's not worth it to disincentivize reporting, and it also helps to educate people on how the rules work when there is confusion. Like now.
