I don't think someone willing to commit treasonous and felonious acts ever deserves to even be offered citizenship.
If we are going full Heinlein then the option for such a privilege should only be offered to upstanding citizens to begin with.
If we are going full heinlein public floggings for criminal behavior are on the table, which I think would do nicely as a deterrent for future waves.
Giving them the benefit of our justice system is still acknowledging their right to being treated like a person or an equal to our citizenship. Which a foreign agent committing felonies on our soil does not deserve.
