I don't know that you can ever have fairness in a system where prosecutions are optional. In no case does anyone challenge the ability of a DA to not bring charges. Therefore which charges are brought is up to some guy's opinion. That he is an elected guy doesn't make the justice meted out any more fair. I don't really have a solution.
I don't think you can have fairness, but you can have order I guess. Because what happens is the crooks get in good with law enforcement, who is again perfectly allowed to selectively not prosecute his friends. As long as he stays popular. That's a form of order.
