Mike Rowe was publishing software and had an identifiable brand presence before Bill Gates and Paul Allen picked a name for their sued him for using his own name for his company, and a court still stole his literal name and trademark from him because it was too close to the name of the behemoth that sued him.
There's a complete hack who goes around claiming to be the inventor of email because he made a messaging app he named 'EMAIL'. OPs idea could still work. It's all about how deep your pockets are, and how little greed and sense you have to not settle and turn over the name.

Huh. Dangers of relying on memory. So he basically did exactly what OP is suggesting, and the court system punished him for it.
