So if the family actually takes Kanye to court couldn’t he just pull up the report showing the fentanyl in his system? Or get his own experts? I guess what I’m getting at is of it would get Chauvin a new trial. Or if it could. That was such a strange and extremely biased trial and I would’ve thought any judge worth their salt would’ve declared a mistrial.
I have a friend who to this day believes it was all set up to spark rioting.
But I was just curious. I personally would love to see Kanye crush that greedy family in court.
In non-clown world they would be laughed out of court before it got to that point. Kanye gave his opinion on the facts based on what he's seen, and the guy he's talking about is dead.
No it wouldn't get Chauvin a new trial. One is the criminal system the other is civil, and there's no "new" evidence.
AntifaBLM and their MSDNC allies were most definitely waiting to pounce on such an incident that summer. They kept trying it with other cases before that but were less successful at getting attention until then.
Alex Jones
The lawyer doing this lawsuit specifically named Alex Jones as precedent.
With Alex Jones, the lawsuit at least pretended to be based on valid legal theories. The major problem with the Alex Jones lawsuit is that it was unlawful to hold him responsible for the actions of his listeners. That was the "cheating" leap the court and jury made to get him. However, that kind of point was at least in the realm of arguably that Alex Jones "intended" to set his listeners on the families like a pack of dogs. He didn't, but the jury can lie and say he did to rationalize what they really did - which was to hammer Alex Jones because they want to censor him.
This Kanye suit drops all pretense. It amounts to "thou shalt not speak ill of the magic negro on pain of confiscation of everything you own".
Buried in a gold sarcophagus like a pharaoh (cuz he wuz a kang an shiet)
And his grave has armed guards 24/7 because just like the pyramids, Africans will raid his tomb the second that no one is around to stop them
It's also unlawful to disallow a defendant any defence. Plus I'm pretty sure we're not allowed to advocate violating the law as a legal theory and the guy outright advocated to violate the constitution
Crap. You are right. Didn’t a rapper say if Jones can be sued like that then why not the people who pushed covid misinformation
Anyone who disagrees with the regime can be sued liked that. In the 80s, the Institute for Historical Review put out a $50k reward for anyone that could prove the holocaust happened and a jewish man sued them for it. The judge simply declared the holocaust to be undeniable fact, then ordered IHR to pay him the original $50k offer plus $100k for damages. You don't have to agree with IHR about the holocaust to recognize they got screwed by the courts.
I saw a clip of the dumb black lawyer who is filing the lawsuit. He thinks that there is an "Alex Jones" precedent, where you can just sue Right Wing people because they hurt your feelings. I'm not even kidding. He brought up Alex Jones by name.
George Floyd is dead. He cannot sue for defamation. Nobody else can sue on his behalf.
Apparently they are trying to sue for IIED - Intentional Infliction of Emotional Distress. This is laughable on its face. IIED has a large number of very strict elements. California courts have held for example "there can be no recovery for mere profanity, obscenity, or abuse... or insults, indignities or threats which are considered to amount to nothing more than mere annoyances" or "mere insults, indignities, threats, annoyances, petty oppressions, or other trivialities" & “It is not enough that the conduct be intentional and outrageous. It must be conduct directed at the plaintiff, or occur in the presence of a plaintiff of whom the defendant is aware.” The plaintiff also needs to suffer real damages, not just hurt feelings.
"harassment, misappropriation" are not real causes of action, nor would it ever make sense that they could be in any jurisdiction.
It's a bullshit lawsuit and the lawyer is filing it purely for the publicity and free advertising. And yes, it is being done because the lawyer honestly believes that the Alex Jones case represents a situation where Alex Jones didn't do anything wrong from a legal perspective, but instead got hammered because judges and the jury hated him and were biased against him personally. This lawyer thinks Kanye is similarly vulnerable.
Kanye's lawyers ought to immediately file a demurrer / motion to dismiss. That motion must be granted, because even if all allegations are taken as true, no valid claims have been stated as a matter of law. Any judge who does not grant a motion to dismiss such a case, is willfully defying the law and violating their oath. I wish I could say with confidence that that would not happen, but as far as I'm concerned, judges today are just politicians in robes, and I do not believe that Kanye would receive a fair and honest hearing from most Democrat judges, and especially not from jewish ones.
Yep, the precedent has been set.
There's justice, and there's whatever the fuck this is.
Don't forget disallow defense
But clearly they've claimed Floyd's name as intellectual property
If they take him to court it's thrown out because Saint Floyd of the Fenty is dead
Let’s hope so
