No, but the same factors that determine ability also determine skin color. Genetics are a bitch; some people have the ability to think, and others are hairless chimps, and there's nothing we can really do about it.
That's correct. But if i were to build a hiring system based on propability with skin-color being one of the variables ... well ... It may look like your statement is wrong.
