Surrendered people aren't active combatants, and therefore are considered innocents and civilians. And you don't massacre civvies.
Unlike "Civilians" who are armed with molotovs and whatnot, who are actually active enemy combatants. Them, you can kill, so long as they don't drop their weapons and surrender.
You may hate it, and it was drafted by lawyers so you know, they're probably used to being hated, but the moment the Ukrainian government said on Twitter in a mass broadcast to all civvies to arm all the civvies with incendiaries, was the moment it was legal for Russia to kill them all. Much like EVERY SINGLE TIME IT HAPPENS, grandstanding on twitter is not a good idea when multiple legal issues are involved.
And that is why nobody takes conventions seriously.
The conventions are interpreted generously because they were never written to outlaw military necessity. But if you are declaring ahead of time your intention to commit a war crime, that's premeditated.
