This subsection (2) exemption is part of section 3, foreign nationals. It's not part of section 2, public assembly, as the screenshot wrongly implies.
In practice, it's about keeping Americans out of the protest.
Well that's Justin just cancelled himself if he suddenly attempts a plot twist of "I really was Castro's son" as a means of "I'm really Latinx, therefore: PoC!"
Yup, I'm sure this will be practiced fairly and without bias as all social justice claims it does.
