It's still legally assault and was unprovoked- the peaceful protestors were walking by his place, not stopping and bothering him.
That is assault, they weren't on his property so he had no right to do that.
Not that the police will actually do anything, and even if they did? The Crown (Canada's DA) and the courts will do nothing at all.
