If the case goes to the supreme court there is a much higher chance of it being shut down now than before.

You realize the chances of a case being granted cert in the absence of a judge is basically nil, right?

What happens if a case goes up there and there's only 8?

Roberts is the decider, right? I don't think this changes anything, he's hopeless.

When there is a tie vote, the decision of the lower Court stands. This can happen if, for some reason, any of the nine Justices is not participating in a case (e.g., a seat is vacant or a Justice has had to recuse
