Good luck with that. Moving money from one pocket to another is not a sale, and creates no profit, so there is nothing to report to the IRS. If it isn't reported to the IRS then it didn't happen as far as any state is concerned.
They'll probably use it against people whom had their devices confiscated for a small crime and then add this one on top.
