If you even read the debate on the floor of the 14th it isn’t how it applies in the US either. The SC case just 30ish years later was legislation from the bench that made up the right of children of foreign nationals to be US Citizens. They debated on the amendment applying to Chinese and Gypsy settling in the west at the time and said it did not apply to them at all. The problem is the 14th through the enforcement act allowed the complete destruction of the balance of powers which the Judiciary immediately abused and has continued to do so since then.
