Not proof but there is evidence for it, namely being charged. Grand jury said he might be the guy. They only see one side of the evidence, but that side exists.

How do you explain the 18 tons of smoke? If you accept that there is indeed smoke, what's your alternative hypothesis that explains all the smoke?
