Its from the halakha, and I'm not well read enough to know if it was an original rule or was added through the centuries, but its at least recognized as being many centuries old. So it might have had a historical basis but it was recognized as a religious matter.

But that means its a rule they've lived with longer than the history of a most empires and many nations, so its how they accept reality.
