This cannot be our standard. You can almost never prove intent of any kind because it is self reported data from a person who has already demonstrated a capacity to commit a terrible crime. You do not trust such people to honestly report their innocence to the court. You throw them in prison as you would any “evil” person because there is no way for you to tell the difference.

Introducing these subjective excuses into the system completely undermines any semblance of justice. Judges abuse this bullshit specifically to undo the principle of blind justice. These little kings in black robes think that they should have total leeway to address whatever inequities they believe to exist in society, but that is not their purpose.
