for websites that host art this is very easy to handle, make a section for AI only, and voilà.
the guys that are selling those packs claim it is a reference pack and they manually edited the drawings, which could actually be true considering when I generate these, the hands always come out wrong and I have to fix them manually as well.
there is clearly an attempt to workaround against the no AI rules, and considering artstation takes a cut on these sales I think they will close an eye

Paid work distribution sites are still having issues, but Pixiv did this early to fencesit on the issue. It has surprisingly worked out pretty well, you just have to trust people are marking their works as AI. The only other downside is the "hide AI" images filter seems to only function for tags and searching, so if an "artist" you follow starts going down the AI path, you're kind of stuck with either putting up with it or chucking them entirely.
Pretty soon it's going to be mandatory to have to provide WIP evidence that AI can't fake for any artwork if you care at all about peoples' perception of you as a professional. It looks like a lot of these sites and competitions are too fucking lazy to do that sort of checking though. Devlogging is going to be absolutely necessary to show people you're not a faker.
Didn't Artstation make a big todo about banning AI?
Yes

What is artstation?
Deviantart in a monocle and top hat.
Well said.
