There are three relevant countries which have not signed the ban on cluster munitions. Russia, Ukraine, and the United States.
They can't lawfully attack "indiscriminately", but they can lawfully attack the military objective even if that means collateral damage to civilians.

If you were going to kill people indiscriminately, it would be smart to do it in a place where the people aren't in large part Russians / Russian speakers, like Lwow. Reducing Mariupol seems counterproductive, whether or not it was justified under ius in bello.
