If you make a fake rape accusation there is now no incentive to recant because one of you are going to die. This will have the opposite affect you want it to have.
Right, they already get away with the crime and it's not like they get anything out of telling the truth. How often do false rape accusers have a sudden change of heart and tell the truth out of a moral duty? Literally never. You can't make a situation worse if it's already mathematically as bad as it can get.
Which is why the threshold of evidence must be extremely high for death penalty convictions.
I am not of the belief that we should convict based upon a person's say so alone. Too many times, innocent people have been smeared or worse because someone decided to lie. Perjury should earn the same fate as the case they were lying about. The lack of punishment for perjury has led to many innocent people being convicted. If you can't prove a crime with physical/digital evidence, there is no crime.
I would hope the irony of making both rape and false rape accusations a death penalty offense is not lost on you.
