It's true, but also (while not a lawyer) I'm fairly confident it's not possible to prove you weren't chosen because discrimination unless you have an audio/video recording of recruiter looking specifically at your resume and saying "nah, Bobby is too white".

When Ive used to apply to places like blizzard, I would send several dozen applications every week, and would only hear back from one or two places. Further even when I did well in interview it was 50/50 whether they've moved to next round or rejected me for obscure reasons or just ghosted outright.
Yes but think about it this way.
Most jobs are lower skilled (just by nature). Most of the applicants affected by this are starting careers. You're trying to find work, not spend years of life + millions of dollars on litigation. Even if you win against hostile courts, hostile media, you're a villain in HR forever because these people are true believers.
The one guy who recently won his case after his job was replaced by diversity hire women/blacks was more established. Those are the guys who can actually afford litigation and may not have any fucks to give about being blacklisted because they've got the references to find other work. (People starting out usually don't.)
They have other ways, HR is 95% female. There are established private networks of women in companies now that would revolt.
I had a lovely talk in my new job during the introduction about how oppressed women are in the workplace and how afraid they are to talk to their managers, therefore a network of women is necessary. Oh it's also for men, not just women, but actually it's just for women.
Honestly, it instantly made me feel like leaving the company but the work is good and I haven't had any of that bullshit since. The major irony was the women were silent during this talk, the men were doing all the talking. It made me repulsed to hear men going along with this bullshit, one was some floppy haired zoomer Arab looking faggot who probably has arranged marriages in his own country. "This proves women are afraid to talk, because men are doing all the talking", he said proudly.
When did work stop being about work and how qualified you are? oh wait, it didn't, that's why the women are all in HR and not qualified enough to do actual technical work, then the rest of their careers are spent denying reality.
