Sorry this has as much force as "can't discriminate against blacks for employment" when all you have to do is NOT say "we don't hire black people".
That's a bad analogy because disparate impact theory. If you don't hire any blacks, the secondary constitution for minorities kicks in and you'll be punished even if no black people ever applied.
