Probably. They have to prove that he went there with the intention to murder somebody, which seems unlikely.

I don't yet know what precipitated him being chased by Face McShooty (the same belligerent shouting "Shoot me nigga! Shoot me nigga!" at the guys defending the gas station), but he was clearly running away from trouble, and being pursued.

P.S. "Shoot This Guy in the Face" quest completed.
