To be honest, the laws that exist in Western countries regarding this particular aspect of Japanese "art" is our tried-and-tested "we make this bullshit up as we go along to make sure you get in trouble and we don't and you can't do shit because we hold all the power lololol".
To me, the law should be as thus:
Anything 2D is considered drawn art, regardless of how tasteless or pornographic, and protected UNLESS it implies the abuse of a real, living individual. Otherwise Steve-O should have been arrested for his "ostrich" tattoo.
Anything 3D but non-naked UNLESS sexual acts are DIRECTLY implied in the photos/footage should be considered regular photogtaphy and likewise protected unless the model objected to her treatment at a later date or they were abused/murdered (not going to name the specific sites certain images originated from but 8ch used to be raided by it like a fucking plague). Otherwise, the perverts who take creepshots will get punished if they ever take a photo of someone they thought was an adult and it turns out they weren't. They're fucking losers, sure, but not pedos.
Anything 3D and naked? Illegal to own, jail time if found in possession. Ditto anything clothed where a sexual act is directly implied.
Paying for or aiding in the production of real child exploitation? Life imprisonment, with a mandatory hour of gen pop every week to see how long you can survive.
Actively producing CSAM or trafficking kids? Automatic death sentence, no matter where you are in the world.
Fucking or otherwise sexually abusing kids? Woodchipper AS A FUCKING P.
