"Doesn't deserve to die" has got to be one off my least favorite "logical" arguments. And any of that similar framing; "death sentence," "execution," and the like.
That's not what happened. That's not what happens when a thief or attacker gets gunned down in self defense, either, or any of those scenarios.
It's never about whether they deserved to die, or not. It's about someone putting themselves in a position where a level of force could be used against them defensively that might lead to death.
The point isn't "Neely deserved to die," the point is he put himself in a position where someone was right to restrain him. He wasn't executed, he didn't receive a death sentence, and it doesn't matter if he "deserved" to die or not. And Penny never claimed he deserved to die, and neither did the judge or jury. Neely fucked around, and found out.
Not to mention that Neely was still alive when the paramedics took him in custody. Penny did not kill him. He was still breathing at the time, and Penny did not inflict any injury upon him beyond that chokehold.
He died of an overdose.
