With the civil rights act I can see the government saying we won’t discriminate but it does violate free association. Goldwater’s concerns were correct. Especially with the adding of “gender identity”
The civil rights act should be repealed. I should have the freedom to hire whoever I want. Why freedom of association ends at personal relationships is beyond me.
Even discussing government actions alone, the Civil Rights act and 14th amendments somehow started demanding racism once the legal system added "disparate impact" theory to the mix. A naive reading of the laws would make you think any Black man and any White man must be treated equally by the government. The courts don't see it that way. They look at the outcomes of government programs over entire "classes" of people. If the outcomes are different, that is seen as evidence that Blacks and Whites were treated differently, so the government must now start giving preferential treatment to Blacks.
Which is wrong. The only thing that can be guaranteed is equal opportunity assuming the person puts forth the effort. Disparate impact is an endless loop. Sowell has pointed out how there are numerous factors that can affect t people positively or negatively. I have tried to explain to some relatives that getting rid of affirmative action and firing those who constantly ramble on about historic systems oppression is better for blacks in the long run. Definitely better for whites and Asians because they can actually get a fair shot. I do think reversing the obsession with diversity and inclusion is possible but it’ll take a while
