The artist John Jomita jr once said in an interview how much he was keen on working with writer Chuck Dixon on the Punisher because Frank Castle is the only Marvel hero of Italian American descent. He was kinda wrong, because he forgot about Nick Fury

Was about to say that MCU Nick Fury was a special case--when Marvel launched the Ultimate line of comics, they approached Jackson for the rights to use his likeness, and he agreed, on the condition that from that point forward, he would have exclusive rights to portray the character in movies.

In other words, he bet on himself, and hit the jackpot.

No they didn't, which was the original problem. SLJ had Marvel over a barrel for using his likeness without originally asking so getting the MCU role was both easy for him and probably one of the few ways Marvel could get out of it without being sued.
