It doesn’t make it legal according to the fundamental rules and universal shared understanding of contracts (and basic logic) going back to the dawn of civilization, but it DOES make it legal the way modern American law works. Clown law has been the way of the courts for decades now.
I could be wrong but this sounds like theft, larceny, and racketeering. All of which are prosecutable financial crimes.
