The problem is that hospitals operate with a de facto monopoly in 35 states. In order to get permission to build a new hospital, you need to apply for a "Certificate of Need," certifying that there is a need for a new hospital in the community.
With rules like this, it's no wonder that American healthcare is so expensive. The free market is simply not allowed to operate in healthcare.
The fact that any of this was even proposed, much less had to be taken to court to get shot down, is an outright loss.
Sure this is good for me personally because it means my career can survive in the private sector, but I think it's a mistake to view this as a win rather than something akin to cauterizing a wound. We're still in a bad spot and it shouldn't have come to this.
The comments made by the three leftist judges during oral arguments should have created a permanent rift between them and the rest of the court. There should be no reason to side with the leftist judges on anything ever again.
