Pashtun have an honor based society and are not godless commies so there's at least a chance the pardons are real. e: And just to clarify, the pardons may be real for those that accept the pardons; they also hate cowardice so anyone they find huddled in the airport left behind by the Americans will definitely be killed.
It's probable they have a system of rules they "officially" intend to support, but that they are so disorganized and backwards that the soldiers are like roving gangs of horny cavemen that they can't control even if they wanted to and even if there wasn't a fog of war. So if some soldier rapes and kills a girl for fun, well, their leaders just give them a slap on the wrist if anything. "C'mon Amir we gotta follow Sharia. This is your third rape this week, don't let it happen again."
Basically how armies have operated forever.
