As of May 21, no Texas Government entity at the State, County, or Local/City Level may issue a mask mandate or requirement. Violating entities are subject to a $1,000 fine per occurrence. As of June 4th, no Public School may require masks for students, teachers, staff, or visitors.

Why can an EO mandate masks in all areas of public accommodation like private businesses but an EO can't prohibit them?

Cherry-pick some studies that say wearing them presents a health risk to the person wearing them, same as they cherry-picked studies that said they helped. Then not wearing them becomes a public health issue.
Completely agree. The Texas Legislature only meets every 2 years for a limited period of time to put restraints on runaway legislation and the "permanent deep state".
(Edit - meant to add) -- The current session expires on 5/31. I do not believe that legislation pertaining to this EO can make it to the floors of the House and Senate in time for passage.
Historically Governors will call an emergency session immediately after the scheduled session closes with a specific agenda outlined for consideration. It is my hope that this EO and GA-35 (no vaccine passports) can be codified into law during an Emergency Session.

There are bills in house and senate regarding masks, hopefully they pass. It's a pretty right wing legislature.
I'm wary of EOs coming from Red governors, precisely because -- as has already been mentioned and as we saw with Trump's EOs -- they're a pen stroke away from being tossed out.

Meanwhile, the government of Québec just announced restrictions will continue well into the Summer, while gaslighting us saying this is better than last Summer.
