TLDW: Colin Noir points out that carrying a gun at a protest is constitutionally protected, however Pretti was being very dumb attempting to physically intervene with officers.

My Take [I AM NOT A LAWYER AND THIS IS NOT LEGAL ADVICE]:

  1. Pretti was a cunt and part of a larger machine built to agitate and annoy officers, as well as impede officers by warning perps of their presence using noise makers. Pretti was not personally using noise makers even though he was yelling, but he was filming for two women who were.

  2. the environment leading up to the situation was already tense, with multiple people on social media bragging about shooting ice agents.

  3. the initial scuffle started because the Ice agents started pushing back the agitators, likely to get them clear of their car. however, it appears the ice agents caved to the agitation as they kept pushing after the agitators were clear.

  4. Pretti physically intervened. while he did put his hands up, he still inserted himself between the officers and the agitators. This is grounds to detain him. Pretti was being stupid.

  5. While detaining him, one ice officer yelled "gun" and within seconds the first shot went off. "Gun" was yelled even though both of Pretti's hands were secure. he did not reach for his waistband until after the first shot went off. practically speaking, Pretti's gun was removed at the same time he was shot, the agent firing the shot could not reasonably know that the gun was no longer in play. The ICE officer who fired the first shot did not draw his gun until after another officer yelled "gun".

  6. after the first shots were fired the rest of the agents backed off and fired more shots into Pretti. this seems to be more of a result of hearing the shots being fired, rather than the officers observing any aggressive behavior from Pretti.

Conclusion: Pretti was being stupid and was rightfully being arrested, but the officers let their emotions and fear get the better of them and wrongfully shot Pretti. In my opinion, the officers should not be protected and they deserve jail for negligent homicide. it was not an execution like the left is claiming, the whole thing was a series of poor judgment by all parties involved that lead to an unnecessary shooting and unnecessary death. additionally, the politicians and social media influencers calling for violent action against ice need to be held accountable.
