I think it would open them up to lawsuits by rejected students. I imagine the details are hairy, and I don't know them. But it seems like what is being established is whether students who have been obviously discriminated against based on their race can sue. It happens to be Asians as the victims.

I believe the affirmative action thing was a loophole provided by the Supreme Court, after they struck down race quotas.
Right, you can't have quotas, but you can give points.
