This is but one example of why the "hate crime" concept is so dangerous. What's the crime here? Importuning?
Here some rando racist spoiling for a fight rants at an Asian guy and he's arrested, even though no blows were exchanged. Ooooooh! Wet your panties! a VERBAL "assault." Oh dear!
Sticks and stones, motherfucker.
P.S.
The fact that this was made a "news" item is troubling. Clearly it advocates the prosecution of "hate crime" and by implication, "hate speech."
So then certain motives carry stiffer penalties. Like if I stab someone of a different race and kill him, would I get a harsher sentence if it turned out at some point I called him some nasty racist slur? Or if I raved anti-homo stuff at a homo before killing him. Is this like "malice aforethought"?
It seems to me that assigning motive is a pretty dodgy thing.
You stabbed Mr. Green because you wanted his wallet.
Or, you stabbed Mr. Green because he has green skin.
The second case is a "hate crime," OK.
Why not just call it "racist crime" or "race crime"? "Hate" is way too vague.
Police?

Assault probably. Because leaving aside the ethnic nonsense, he intentionally made these people feel threatened.
Come now, you expect 'journalists' to report on actual news, rather than viral videos? That is so hard.
Suspect is black, so he'll be let out immediat- ohh I see what you did there
