Reading the New York Post article, I was going to say that at least the child had been breastfed, meaning the couple weren't so stupid as to try to wean him off animal products at birth... but they'd already had one child taken away from them when living in Virginia in a previous malnutrition case. So yeah, it's pretty easy to prove this is depraved indifference and not run-of-the-mill negligence when the courts have already punished them once for starving their children.
