Yes, telling someone you're on birth control when you're not should absolutely be rape. Especially when a woman does it, because she financially benefits from the lie. It should be rape and fraud.
It's completely different, as stealthing exposes them to your myriad of sexually transmitted diseases, while not taking birth control does not.
I assume you think a woman breathing is 'rape'.
