got it maybe poorly worded, but supreme court is not there to change or create laws, simply pass judgement based on laws
SCOTUS created both those laws whole cloth. They came close to admitting they make up laws in Roe V. Wade by saying it was found in the "penumbra" of the 14th amendments due process clause; as in, it isn't actually in there, but if you squint real hard and arbitrarily redefine words anything is possible.
What country uses this system? It certainly isn't found in the Anglosphere.

Congress passed a federal law forcing gay marriage on the states? Who wrote the law that mandated the legality of abortion?
democrats likely; generally house writes laws and senate passes/rejects the law; executive can veto the law at this point too
