Wade by saying it was found in the "penumbra" of the 14th amendments due process clause; as in, it isn't actually in there, but if you squint real hard and arbitrarily redefine words anything is possible.

democrats likely; generally house writes laws and senate passes/rejects the law; executive can veto the law at this point too
