Its a feint. It cannot be called unconstitutional if it comes from the corporations not the feds. Sidesteps the constitution (or perverts it, depending on your perspective) and makes the government immune to any blame over it while leaving them a permanent GOOJF card down the road if they ever mandate against it, even by a small degree.
Bottom line, they don't have to make it law to make it "law".
