an ineffectual punishment with no power to deter is better than no punishment at all

Wrong.

This gives the appearance of punishment which serves to dissipate the righteous fury directed at these people while doing nothing to actually correct the problem. It is worse than doing nothing, for it weakens the resolve to see wrongdoing punished.
