Nobody would have ever given two shits about his game if he hadn't used the fame of Mario to get recognition. Even worse, maybe people would have been interested, but he blew it by infringing on someone else's IP instead of coming up with his own.

just make your own, it can be as derivative as hell as long as there isn't a reasonable "confusion" argument
