I'm pointing out the hilarious fact that to essentially bypass this law all you need to do is say you identify as X.
There's literally no legal way for them to verify or challenge your claim. Self-identification is exactly just that, self-identification. The only person who can know if your claims are true or not is yourself.
Can you imagine the legal shit show if they tried to legally regulate what qualified as X?
Ex:
"To identify as gay you must have performed fellatio on the member of the same biological sex no less than X amount of times."
