“from an underrepresented community” means an individual who self-identifies as Black, African American, Hispanic, Latino, Asian, Pacific Islander, Native American, Native Hawaiian, or Alaska Native, or who self-identifies as gay, lesbian, bisexual, or transgender.”
“Female” means an individual who self-identifies her gender as a woman, without regard to the individual’s designated sex at birth.
So theoretically companies can literally have an all white blonde hair blue eyed straight male board. But as long as enough of them “self-identities” as whatever the law requires there to be. The government can’t do shit. Since there’s literally no legal framework to determine the limits or validity of “self-identification”
You are nuder the assumptions that companies do not want to do this type of shit but the truth is that inside this companies there is a good push for all the mandated diversity so any encouraging is going to push it even further.

There's literally no legal way for them to verify or challenge your claim. Self-identification is exactly just that, self-identification. The only person who can know if your claims are true or not is yourself.
Can you imagine the legal shit show if they tried to legally regulate what qualified as X?
