Despite Biden and Obama complaining about the illegitimacy of the pseudo-judicial military courts for "Enemy Combatants" (being that they are effectively unconstitutional) both of them continued to use these military courts because dragging these individuals into US Federal Court could basically undo the extrajudicial system that the Bush admin set-up, and allow them Constitutional protections under US law, possibly even destroying Hamdi v. Rumsfeld decision by SCOTUS that created the "Enemy Combatant" rule in the first place.
For some reason, Biden's Secretary of Defense (Lloyd Austin) and his fellow confederates agreed to a plea deal that would stay the executions of Khalid Sheik Mohammed, Walid Bin Attash, and Mustafa al-Hawsawi. This caused a public relations scandal. As a result, Lloyd Austin simply had the judge in their case removed to try and invalided the plea deal. The attorneys for the terrorists, obviously, appealed to... well, the same military pseudo-court system that just had a judge removed by the SecDef. The court found it's own behavior correct, and that the SecDef couldn't just remove a judge that the SecDef didn't like because the SecDef agreed to a plea deal that was no longer palatable politically.
So, after having promised to undo the Patriot Act, end the Enemy Combatant Courts, and Close Guantanamo Bay 17 years ago, the final act of the Obama & Biden regimes was to do none of those things, and then spare their lives.
I will remind you that at the time, there was a fair bit of anger from Congress regarding the congressional review of the Bush Regime's Torture Program because the CIA had secretly hacked into Nancy Pelosi's office to review the memo ahead of time, which was a criminal act that they were not held accountable for. At the time, the Democrats believed that ever since the creation of DHS, the intelligence agencies were running wild... really they were just serving a Republican president. Once the Dem's got ahold of the intel agencies themselves, they saw no issue with any of the actions the intel community did or is continuing to do.

The object was to violate civil liberties, not to get "the tehrists".
